By downloading, accessing, or using the Ember app, or by visiting this website, you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the app or the website. These terms apply to both the mobile application and the related marketing and support pages operated under the Ember - Wellness Journal brand.
Description of service
Ember is a personal wellness journaling application designed to help users record daily experiences, recognize patterns over time, and keep a private long-term record of midlife wellness. Ember is not a medical device, diagnostic tool, therapy product, or substitute for professional healthcare. Information within the app is based on self-reported data and generated reflections. Nothing in the app or on the website constitutes medical advice, diagnosis, or treatment guidance.
Eligibility
The app is intended for users aged 18 and over. By using Ember, you represent that you are at least 18 years old and legally able to enter into these terms.
Subscriptions and billing
Ember offers premium access through three standard subscription tiers: $4.99 per month, $49.99 per year, and $99.99 for a lifetime purchase, along with a 7-day free trial that begins when you save your first daily check-in. Billing is managed by Apple through the App Store or by Google through Google Play, depending on your device. Subscription renewal, cancellation timing, billing authorization, and any available refunds are governed by the platform policies of Apple or Google. You can cancel at any time through your device subscription settings, and any refund request is subject to the applicable app store's policies rather than direct handling by Ember.
Gift subscriptions
Ember may offer gift subscriptions, including an annual gift plan priced at $49.99. Gift codes are non-refundable once redeemed. Gift access is subject to any activation, redemption, and expiration rules communicated at the time of purchase or redemption.
Acceptable use
You may use Ember only for lawful personal purposes. You may not reverse-engineer, copy, reproduce, modify, redistribute, or create derivative versions of the app, website, or their content except as permitted by applicable law. You may not use the service in a way that interferes with the operation of the app, attempts unauthorized access, abuses purchase systems, or uses Ember for any unlawful, fraudulent, or harmful purpose.
Intellectual property
All content, design, features, visual elements, branding, and software associated with Ember and this website are the property of the app publisher or its licensors and are protected by applicable intellectual property laws. The name Ember, the Ember Name feature, all generated portraits, letters, and reflective content, and all supporting branding and site materials are proprietary and may not be copied or reused without permission.
Disclaimer of warranties
Ember is provided on an "as is" and "as available" basis. We make no guarantees regarding accuracy, availability, uninterrupted operation, or fitness for a particular purpose. We do not warrant that the service will always be error-free, secure, or free from interruptions, and we do not warrant that any reflection, report, or generated content will be complete, accurate, or appropriate for your specific circumstances.
Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of Ember or this website. This includes loss of data, loss of goodwill, interruption of service, or reliance on content generated within the app. If liability cannot be excluded, it will be limited to the amount you paid for the service during the twelve months preceding the claim.
Termination
We reserve the right to terminate, suspend, or restrict access to the service if we believe you have violated these terms, misused the product, or engaged in conduct that may harm the service, other users, or our legal interests. You may stop using Ember at any time by uninstalling the app and discontinuing access to the website.
Changes to terms
We may update these Terms of Use from time to time. If we make material changes, we may provide notice through the app, on the website, or through another reasonable channel. Continued use of the app or website after the updated terms take effect constitutes acceptance of the revised terms.
